E-FOODIE, INC. PRIVACY POLICY

Your privacy is important to us at E-FOODIE, INC. (the "Company") so for the e-foodie application ("e-foodie" or the "app") and the associated websites (www.efoodie.com and other Company websites, collectively the websites and the app are referred to as the "Service") we have developed this Privacy Policy that covers how we access, collect, use, disclose, transfer, and store your information. Please take a moment to familiarize yourself with our privacy practices and contact us if you have any questions.  

 

Information Collection & Use

We collect information that can identify you such as your name and email address ("personal information") and other information that does not identify you. We collect this information through a website or a mobile application. By using the Service, you are authorizing us to gather, parse and retain data related to you and your use of the Service. The Company is the sole owner of the information collected through the Service.

 

In order to use the Service, you must create a user name and password.  During registration you give contact information (such as name and email address). We use this information to contact you about the services which you have expressed interest. You may also provide demographic information (such as age and gender) to us; we encourage you to submit this information, so we can provide you a more personalized experience on our site. 

 

If you use a service or other application, such as a social media account, for logging in  you authorize us to access certain account information, such as your public profile (consistent with your privacy settings in that service), your email address, interests, likes, gender, birthday, education history, relationship interests, current city, photos, personal description, contact lists, and information about and photos of your contacts who might be common contacts with other e-foodie users.

 

You will also be asked to allow us to access your location information from your device when you download or use the Service. You may disable location services in your device or application but will then need to provide such information for use of related features in the Service.

 

In addition, we may collect and store any personal information you provide while using e-foodie. This may include identifying information, such as your name, address, email address and telephone number. You may also provide photos, a personal description and information about your preferences for recommendations, such as search distance, offer types desired and requests for contacts with other users. If you chat with other e-foodie users, you provide us the content of your chats, and if you contact us with a customer service or other inquiry, you provide us with the content of that communication.

 

Uses of Information

Communications from the Site

We will occasionally send you information on special deals or promotions. You can sign up for these notices from us on the registration page or your services settings in the app. If you do not want to receive such notification from e-foodie, please disable your account and uninstall the app from your device.

 

Referral Service

If you choose to use our referral service to tell a friend about our site or a special offer, we will ask you and access your contacts on your device for your friend’s name and email address. With any shared offer or invitation, we will automatically include with your message to your friend a one-time invitation to the Service. The Company may access this information for the sole purpose of sending this one-time email and tracking the success of our referral program.  Your friend may contact us at support@e-foodie.com to request that we remove this information from our database.

 

Customer Service and Service-related Announcements

We will send you strictly service-related announcements on rare occasions when it is necessary to do so.  For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature.  If you do not wish to receive them, you have the option to deactivate your account.

 

Based upon the personally identifiable information you provide us, we will communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email or posts in the app.

 

Service Providers

We use other third parties to provide hosting and data storage for the Service. These providers are required to protect personal information, but their policies and practices may differ slightly from our own. We encourage Business Partners to adopt and post privacy policies. However, their use of Personal Information obtained through e-foodie is governed by their privacy policies and is not subject to our control.

 

Profile

We store information that we collect through cookies, log files, clear gifs, and third-party sources to create a "profile" of your preferences. We tie your personally identifiable information, and your history through your application store, to information in the profile, in order to provide tailored promotions and marketing offers and to improve the content of the site for you.

 

We share your profile with other third parties for the purpose of providing individualized promotions and advertising on our Service that allow us to maintain the "no cost" nature of the Service. We allow these service providers, advertising companies, ad networks, and other third parties to display advertisements on our Service. These companies may use tracking technologies, such as cookies or web beacons, to collect information about users who view or interact with their advertisements. We do not provide any personally identifiable information to third parties.

 

Third Party Advertisers

The ads appearing on this Service are delivered to users by our advertising partners. We share Web site usage information about users with a these and other reputable third-party advertisers for the purpose of targeting our advertisements on the Service.

 

These providers use cookies and clear GIFs on the Service, which allow them to recognize a user's cookie when a user visits the Service. The information that they collect and share through this technology is not personally identifiable. 

 

Some of these third- party advertising companies may be advertising networks that are members of the Network Advertising Initiative, which offers a single location to opt out of ad targeting from member companies (www.networkadvertising.org). Opting out will not decrease the number of advertisements seen in the Service.

Personally Identifiable Information

When you register as a user of the Service, your profile will be viewable by other users of the Service. Other users will be able to view information you have provided to us directly or through other links you have provided (for example social media accounts), such as your photos you upload, your name, your age, your personal description, and information you have in common with the person viewing your profile. If you opt to contact another member, and they agree, then you will be able to chat and each of you will be able to view the chat information.

 

While we may monitor chats between members, we do not guarantee the receipt of these sessions by other members nor are we responsible for the information contained in such chat sessions. Personally identifiable information provided in these chats will be available for the other member or member to see and use. We do not share your personal information with others except as indicated in this Privacy Policy or when we inform you and give you an opportunity to opt out of having your personal information shared.

 

Legal Disclaimer

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our company or our Service. In the event the Company goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred.  You will be notified via email or prominent notice on our Web site for 30 days of any such change in ownership or control of your personal information.

 

 Choice/Opt-out

We provide you the opportunity to ‘opt-out’ of having your personally identifiable information used for certain purposes, when we ask for this information.  If you no longer wish to receive our promotional communications, you may opt-out of receiving them by terminating your use and uninstalling the e-foodie app and the Service from all your devices. We may offer an opportunity to opt-out of certain communications on our Service.

 

You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.

 

Do Not Track

Our app and websites do not collect Geo-location information and do not track customers over time or across third party sites to provide targeted advertising and therefore we do not respond to Do Not Track (DNT) signals for our websites.

 

However, some third-party advertisers do keep track of your activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites or apps, your device or browser may allow you to set the DNT signal so that third parties know you do not want to be tracked.

 

Log Files

As is true of most websites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. 

 

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole.  We do not link this automatically-collected data to personally identifiable information. 

 

Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We may in the future use cookies on our website. We do not link the information stored in cookies to any personally identifiable information you submit while on our site. 

 

We may use both session ID cookies and/or persistent cookies.  We would use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s "help" file. If you reject cookies, you may still use our site, but your ability to use some areas of our site, such as contests or surveys, may be limited.

 

Some of our business partners (e.g., advertisers) use cookies on our site.  We have no access to or control over these cookies. This privacy statement covers the use of cookies by our websites only and does not cover the use of cookies by any advertisers.

 

Clear Gifs (Web Beacons/Web Bugs)

We or our third-party advertising partner employ software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help better manage content on our Service by informing us what content is effective.  Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of users.  In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customers’ personally identifiable information. We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients.  This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.  If you would like to opt-out of these emails, please see "Choice and Opt-out".

 

Mobile App

When you access any of our Services through the app, you may manage how your Personal Information is shared with us. You may manage how your mobile device handles ad-related tracking technologies by adjusting your mobile device privacy settings. For example, the "Privacy" settings of an iOS device will allow you to "Limit Ad Tracking" and reset your mobile device’s "Advertising Identifier." Please refer to instructions provided by the manufacturer of your device to learn how to adjust your mobile device settings. You may also opt-out of receiving different types of push notifications or alerts by toggling off the "Notifications" options within the "Settings" menu of our mobile applications. This feature is available in the most recent versions of our iOS-based and Android-based applications.

 

Information you provide about yourself while using our Service

We provide areas on our Service where you can post information about yourself and communicate with others. Such postings are governed by our Terms of Use. Whenever you voluntarily disclose personal information on publicly-viewable pages, that information will be publicly available and can be collected and used by others. If you use a chat room on this Service, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. We reserve the right to terminate the accounts of visitors who use these services in a manner inconsistent with your Terms of Use.

 

Children's privacy

Although our Service is considered a general audience Service, we restrict the use of our service to individuals age 13 and above. You must be over the age of 13 to use the Service and create a user profile. We do not knowingly collect, maintain, or use personal information from children under the age of 13.

 

Visiting our Service from outside the United States

If you are visiting our Service from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States and globally where our servers are located, and our central database is operated. By using our services, you understand and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this privacy policy. The Company is headquartered in the United States of America. Personal Information may be accessed by us or transferred to us in the United States or to our affiliates, business partners, merchants, or service providers elsewhere in the world. By providing us with Personal Information, you consent to such access and transfers. You also acknowledge and agree that Personal Information may be subject to access requests from governments, courts, law enforcement officials, and national security authorities in the United States in accordance with United States laws. We will protect the privacy and security of Personal Information according to our Privacy Policy, regardless of where it is processed or stored.

 

To ensure adequate protection of personal data of the European Economic Area (the "EEA"), any transfers of such data outside of the EEA will be pursuant to the Model Clauses approved by the European Commission. We commit to resolve complaints about your privacy and our collection or use of your personal information. No Rights of Third Parties

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the website.

This Service may contain links to other sites that are not owned or controlled by the Company. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of every Web site that collects personally identifiable information. 

 

Access to Personally Identifiable Information

If your personally identifiable information changes, or if you no longer desire our service, you may deactivate it by using the "Delete Account" button in the "Edit Account" section of the App or by emailing our Customer Support at support@e-foodieapp.net or by contacting us by postal mail at the contact information listed below.

 

Security

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.  No method of transmission over the Internet, or method of electronic storage, is 100% secure, however.  Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. You should not expect, that your personal information, chats, or other communications will always remain secure. Users should take care with how they handle and disclose their personally identifiable information and should avoid sending such information through insecure methods.
